Subprocessors

This Subprocessors Policy describes the third-party service providers (“Subprocessors”) engaged by Banyan AI (“Banyan,” “we,” “us,” or “our”)
to process personal data and customer content in connection with the provision of our services.
This Policy applies to all customers and supplements our Privacy Policy, Data Processing Agreement (DPA), and LLM & AI Usage Policy.
1. Definition of Subprocessor
A Subprocessor is a third party authorized by Banyan AI to process personal data on our behalf in order to provide specific services
related to our platform, such as cloud infrastructure, data storage, or AI model processing.
All Subprocessors listed below process data solely for the purposes described and in accordance with contractual obligations that require
appropriate technical and organizational safeguards.
2. General Principles
- Banyan AI engages Subprocessors only where necessary to operate and improve the service.
- All Subprocessors are bound by data protection obligations consistent with applicable privacy laws.
- Subprocessors may process personal data, business data, metadata, and customer-provided content depending on the service provided.

Banyan AI uses provider features to opt out of model training where possible. Data submitted to Subprocessors is processed to provide the service,
subject to the selected provider’s terms and configuration.

4. Data Location & International Transfers
- Banyan AI’s primary application infrastructure is hosted in Germany.

Certain Subprocessors, particularly AI model providers, may process data outside the customer’s country or region depending on provider infrastructure
and customer configuration. -
Where required, international data transfers are governed by appropriate transfer mechanisms, including Standard Contractual Clauses (SCCs),
and other legally recognized safeguards where applicable.
5. Changes to Subprocessors
We may update our Subprocessors from time to time as we evolve our services. We will provide reasonable notice of material changes
by updating this page. The “Last updated” date at the top of this Policy indicates when it was most recently revised.
